1. Conclusion of the contract:

The contract comes into force from the moment you click the “Buy” button until you receive the order confirmation. We reserve the right to reject or cancel orders generated by automated programs or third-party services.

The prices indicated at the time of placing the order are final and include applicable VAT. Complaints and report procedure; out-of-court dispute resolution
On our website elitetextiless.com, we provide you with the opportunity to report products or other content that you believe does not comply with applicable law or our terms of use (report). We will review these reports and notify you of the outcome. If we decide not to take action, you will have the opportunity to appeal this decision. You also have the opportunity to resolve the dispute out of court, as well as to go to court.
In the event of any instance of abuse, we will temporarily (or permanently) suspend the processing of reports and complaints. Below we would like to familiarize you with our standard terms and conditions, which govern the processing and payment of your purchases. The offers on our website www.elitetextiless.com are intended solely for consumers making purchases for purposes other than their commercial or professional activities. The products sold on www.elitetextiless.com are “TEXTILUX (Ecliptic ICN Limited)”.
1. Contract conclusion and delivery of goods
1.1. By placing an order, you confirm that you are making a purchase for private purposes only.
1.2. For orders placed online on www.elitetextiless.com, we only conclude contracts in English. When ordering products from TEXTILUX (Ecliptic ICN Limited), the contract is concluded with TEXTILUX (Ecliptic ICN Limited), 18 Mallow Street Upper, Limerick, LIMERICK, V94N21Y, Ireland.
1.3. By clicking the “Buy now” button, you are placing a binding order for the products in your basket. Once you have placed your order, we will immediately send you a confirmation by e-mail. A binding contract is formed when you receive your order confirmation. Please note that goods ordered against payment in advance (reserved) will be dispatched immediately after we have received the full purchase price and any delivery costs. We therefore ask you to transfer the purchase price immediately after receiving your order confirmation, but no later than within 7 days.
1.4 You agree to the assignment of the seller’s claim for payment of the purchase price to third parties, in particular TEXTILUX (Ecliptic ICN Limited).
1.5 Please note that, by way of exception, we are not obliged to deliver your order if our suppliers fail to deliver the goods properly or on time, despite our compliance with good ordering practices (transaction approval). This exception applies if we are not legally liable for the unavailability of the goods and must notify you of this situation without undue delay. In addition, we must not bear the procurement risk in relation to the goods ordered. If the goods are not available, we will refund any payments to you without undue delay.
1.6 We do not accept the risk that we have to procure the goods you have ordered from another supplier (procurement risk). This also applies to orders for general goods (where only the type and characteristics of the goods are described). We will only supply from stock on hand and from stock on order from our suppliers. Where we supply goods from stock on hand, the goods supplied will be those you have ordered. We deliver within Ireland. Where times are stated in working days, a working day is defined as any day from Monday to Friday inclusive, excluding public holidays.
1.7 We will notify you of delivery times on each product detail page and before you place your order.
1.8 We reserve the right to refuse or cancel an order if the order is placed using software, a robot, spider, search engine or any automated system or script or third party service used to place an order on your behalf.
1.9 We hereby reserve the right to exclude customers with a markedly high (and unusual) frequency of returns from further purchases for a period of up to 12 months. This applies in particular to repeated, disproportionately high returns (or returns behaviour that is considered “abusive”) that do not correspond to normal customer behaviour.
2. Prices, delivery costs and express delivery
2.1 The prices quoted in the offer on the date of placing the order apply. The prices quoted are final, i.e. include Irish Value Added Tax at the current statutory rate. The goods remain our property TEXTILUX (Ecliptic ICN Limited), as the case may be, until the purchase price has been paid in full on elitetextiless.com.
2.2 We will bear the delivery costs for all orders with a minimum order value of €300.00.
2.3 The delivery cost is €30.00 including VAT for all orders under €300.00, as stated on the product detail page and in the basket during checkout. The delivery cost is calculated based on the size of the order, including the costs of handling the delivery and other services. The costs are accrued and collected by TEXTILUX (Ecliptic ICN Limited). In the event that the goods are returned by the customer within the specified time limits and in accordance with this agreement and applicable law, the delivery cost will be refunded.
2.4 Express delivery is available for some orders. When placing an order, you will see whether this option is available for your specific order, as well as the cost. The goods will be delivered no later than 2 working days. If the goods are not delivered within this period, you will of course receive a refund of the delivery cost.
2.5 Depending on the location of your goods being sent, a long-distance delivery fee of €30.00 including VAT may be charged. We will notify you before placing your order if a long distance delivery fee applies to the selected item. Long distance delivery costs are assessed and collected by TEXTILUX (Ecliptic ICN Limited). If you choose to return an item for which a long distance delivery fee has been paid, we will refund the long distance delivery costs provided that the entire order is returned. Your statutory rights remain unaffected.
3. Payment
3.1 We generally accept the following payment methods: credit card, bank transfer, prepayment and payment via PayPal, Strype and other payment services. We reserve the right not to accept certain payment methods for a particular order and to refer you to other payment methods. Please note that we only accept payments from accounts located within the European Union (EU). You are responsible for any costs associated with money transfers.
3.2 In case of purchase by credit card, your card will be debited when the order is dispatched.
3.3 You agree to receive invoices and credits only electronically.
4. Promotional coupons and their redemption
4.1 Promotional coupons are coupons that cannot be purchased, but are issued during promotional campaigns and are valid for a certain period of time.
4.2 Promotional coupons can only be used once when placing an order and only during the specified period. Some brands may be excluded from the promotion. Promotional coupons cannot be used to purchase gift certificates. Please note that a minimum order value may apply for the use of promotional coupons.
4.3 The cost of the goods must be equal to or greater than the value of the promotional coupon. If the amount of the promotional coupon does not cover the cost of the goods, the difference can be paid by any of the accepted payment methods. The value of promotional coupons is not paid in cash and no interest is accrued on it. Refunds for promotional coupons are not made in the event of a full or partial return of the goods.
4.4 Promotional coupons can only be used before completing the order. Retroactive use of promotional coupons is not possible. Promotional coupons cannot be transferred to third parties. Unless otherwise agreed, it is not possible to combine multiple promotional coupons.
4.5 If you have used a promotional coupon when making a purchase and, as a result of your withdrawal, the total price of your order is less than or equal to the nominal value of the promotional coupon, we reserve the right to charge you the original price of the product you kept.
5. Terms of use of TEXTILUX (Ecliptic ICN Limited) gift cards
5.1. TEXTILUX (Ecliptic ICN Limited) gift cards are issued by TEXTILUX (Ecliptic ICN Limited). TEXTILUX (Ecliptic ICN Limited) gift cards are not electronic money, but rather unregulated stored value. This means that TEXTILUX (Ecliptic ICN Limited) gift cards are not supervised by a competent supervisory authority and do not benefit from the statutory protection of electronic money. In particular, you are not entitled to demand their redemption in cash.
5.2. TEXTILUX (Ecliptic ICN Limited) Gift Cards can be used on www.elitetextiless.com to purchase eligible products offered by TEXTILUX (Ecliptic ICN Limited). The products and services included in the promotion are products that serve to enhance a person’s appearance (e.g. clothing, footwear). For more information, please follow the link “What can I use my gift card for?”. A TEXTILUX (Ecliptic ICN Limited) Gift Card cannot be used to purchase another TEXTILUX (Ecliptic ICN Limited) Gift Card.
5.3 TEXTILUX (Ecliptic ICN Limited) Gift Cards are valid for a limited period of 5 years from the date of purchase. No cash refunds or refunds for loss or damage are possible.
5.4 TEXTILUX (Ecliptic ICN Limited) Gift Cards can only be used before the order is placed and are not retroactive.
6. Legal right of withdrawal
When you purchase a TEXTILUX (Ecliptic ICN Limited) product, you have a legal right of withdrawal. First of all, you should know that if you decide to return an item, you can use the return shipping label included with your order or print one from your account page. If you do not have access to a printer, have problems downloading the return shipping label or require a new return shipping label, you can contact Customer Service (contact details below). Please help us avoid unnecessary costs by always using the return shipping label when returning an item.
Recall information:
You have the right to cancel this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party specified by you (but not the carrier) receives the last item.

You can also complete and submit the withdrawal form or other unambiguous statement online via the contact form on our website. If you send a withdrawal notice online, we will send you an acknowledgement of receipt without undue delay (e.g. by email). You will be deemed to have complied with the withdrawal period if you send the withdrawal notice before the expiry of that period.
Consequences of withdrawal
If you withdraw this contract, we are obliged to refund to you all payments received by us, including delivery costs (excluding any additional costs incurred as a result of your choosing a delivery method other than the cheapest standard delivery method offered by us), without undue delay and no later than 14 days from the day on which we receive your notice of withdrawal of this contract. Refunds will be processed using the same payment method you used for the original transaction, unless otherwise expressly agreed with you. We will not charge you any fees for returns. We may delay completing your return until we have received the goods back or you have provided us with proof that you have returned the goods, whichever occurs first. You are obliged to return or hand over to us all goods without undue delay, but no later than 14 days from the day on which you gave us notice of withdrawal of this contract. The above requirement is deemed to be met if you return the goods before the 14-day period has expired. We will bear the return shipping costs, provided that you use the return shipping label we provide to ship from the country to which the delivery was made to you, otherwise you will be required to pay the return shipping costs. You are only obliged to reimburse any decrease in the value of the goods if this decrease is due to your improper handling of the goods when checking their condition, properties and functionality.

The right of revocation expires early in respect of sealed goods that have been opened after delivery and cannot be returned for hygiene reasons.
7. Option to return goods within 30 days of receipt
7.1 Without prejudice to your statutory right of withdrawal, we offer you the option to return your goods within 20 days of receipt. This returns option allows you, even after the 14-day withdrawal period (see the section on “Information on the right of withdrawal” above), to cancel the contract by returning the goods to us (this period begins from the moment you receive the goods).
7.2 If you are returning a TEXTILUX (Ecliptic ICN Limited) product, you can use the return shipping label included with your order or print one yourself from your customer account page. If you have problems downloading the return shipping label or do not have access to a printer, please contact Customer Service.
7.3 Your goods will be considered returned within 20 days if you send them back within this period. However, in order for you to exercise your right to return the goods, it is necessary that you only wear/try on the goods as you would in a store and that the goods are returned in their entirety, in their original condition, undamaged and in their original packaging. Until the statutory right of withdrawal has expired, the statutory provisions governing this right apply exclusively. The option to return the goods does not limit your statutory warranty rights, to which you retain full rights without reservation. The option to return the goods does not apply to gift vouchers.
7.4 The voluntary right of return within 20 days does not apply to contracts concerning sealed goods that have been opened after delivery and which cannot be returned for reasons of hygiene.
7.5 Until the statutory right of withdrawal has expired, the conditions listed in sections 6 and 7 apply exclusively. The voluntary right of return within 20 days does not apply to statutory warranty rights. The voluntary 20-day right of return does not apply to the purchase of gift certificates.
8. Refunds
Refunds will be automatically made to the account from which the payment was made. For invoice and pre-payment by bank transfer, the refund will be sent to the account from which the payment was made. If you paid for the goods via PayPal/credit card, the refund will be sent to your PayPal/credit card account. If you used a gift voucher for the purchase, we will credit the corresponding amount to your gift voucher account.

The order confirmation e-mail contains your order data and our Terms and Conditions and can be easily printed or saved using your e-mail program.
10.4 As a customer, you can contact your local alternative dispute resolution (ADR) body in the event of a dispute that you have not been able to resolve directly with TEXTILUX (Ecliptic ICN Limited). You can use ADR to try to settle out of court, which is usually easier, faster and cheaper than going to court. Please note that the option to use ADR is only available if you live in the EU and the seller is based in the EU.
